Garage Sales

In order to conduct a garage sale permit needs to be obtained, where the person(s) conducting the Garage Sale agrees to comply will all applicable requirements in accordance with the Ordinances of the City of Eagle Pass, Texas, specifically:

Section 19-132. Signage

(a) Signs advertising garage sales shall not exceed four square feet in surface area and no more than four signs may be posted for any garage sale.

(b) Garage sale signs must be temporary signs. No signs may be exhibited more than two days prior to the sale, and all signs must be removed at the expiration of the garage sale permit. The person or persons exercising ownership or leasehold rights over property on which a garage sale is held or advertised to be held shall be presumed to have placed and exhibited the sign advertising the garage sale which identifies the person's address or location at which the garage sale is to be held. This presumption may be rebutted by evidence to the contrary.

(c) Signs may be staked on the garage sale operator's private property and cannot be attached to utility poles, streetlight standards, street right of ways or other public facilities.

Section 19-333. No Food Sales

Sales of food items are prohibited at garage sales. (Ordinance Number 98-40, §1, 11-1-98)

Section 19-134. Garage Sale Permit.

It shall be unlawful for any person to operate or participate in the operation of a garage sale within the city limits of the city, unless the person had first obtained a garage sale permit from the city's planning director.

Each garage sale shall not exceed two consecutive days.

An applicant having a valid permit may operate a garage sale between the hours of 9 a.m. and 6 p.m.

Note: Failure to comply will result in the issuance of a citation to appear before Municipal Court.
